The Appellate Division on Tuesday cleared the way to resume the trial proceedings in the drug case against actress Shamsunnahar Smrity, who is well known by her screen name Pori Moni, by vacating a High Court order of staying the trial.
Now there would be no bar for judge Mohammad Nazrul Islam of Dhaka Special Court-10 to record deposition of a Rapid Action Battalion officer as the plaintiff of the case against Pori Moni, following the six weeks of stay that was granted by the chamber judge Obaidul Hassan.
The government on Monday petitioned in the Appellate Division for staying the HC decision.
On March 1, the High Court stayed Pori Moni’s trial for six weeks asking the government and the CID to explain in four weeks why the proceedings against Pori Moni should not be quashed.
The HC had issued the ruling after hearing a petition filed by Pori Moni for quashing proceedings against her.
Pori Moni filed a petition with the High Court challenging the lower court’s January 5 order of framing charges against Pori Moni and her two associates — Ashraful Islam Dipu and Kabir Hossain — in the case.
