War Crimes Trial
IO’s cross examination by Sayedee’s lawyer allowed for two more days
The International Crimes Tribunal-1 on Wednesday allowed cross examination of investigation officer by the defence lawyer of detained Jamaat nayeb-e-amir Delwar
Hossain Sayedee for two more days.
It also accepted a prosecution plea to receive in evidence the statement of a dead prosecution witness recorded by the investigation officer who was not produced in
the tribunal.
The witness, Mukunda Lal Chakrabartee, died on April 21.
Earlier on March 29, the tribunal received in evidence statements of 15 witnesses recorded by the investigation officer without producing them in the tribunal.
The prosecution had listed 46 witnesses,
On August 2, the tribunal asked the defence counsel to complete the cross-examination of the investigation officer by Wednesday and at the outset on Wednesday’s
proceedings it reminded Mizanul about it.
However, on Wednesday the tribunal gave two more days to the defence counsel to cross examine Helal on August 12 and 13, as Mizanul sought more time to complete his
cross-examination.
On Wednesday, Mizanul Islam cross-examined investigation officer M Helal Uddin, who is the last and 28th prosecution witness against Sayedee for the 46th day.
The tribunal said that no further extension would be allowed for his cross-examination.
Earlier, Helal testified for eight days beginning April 8.
The tribunal rejected a defence application seeking copies of two reports the investigation officer had submitted to the judges on March 17 and 19.
The tribunal said that the copies of the two reports could not be given to the defence as they relate to communication between the inve4stigation agency and the
prosecution.
The two reports also related to prosecution’s contention that production of all the 46 witnesses would involve undue expenditure and cause undue delay in the
proceedings.
Sayedee was on the dock after about two months as he has been under treatment at a city hospital.
As he fell ill the tribunal sent him back to the jail even before the day’s proceedings were over.
On October 3, 2011, the tribunal indicted Sayedee on 20 counts of crimes against humanity.
