The High Court (HC) on Tuesday directed the government not to harass or arrest BNP leaders Salauddin Ahmed and Syed Moazzem Hossain Alal without due process of law.
In response to separate writ petitions, the HC bench comprising Justice Kazi Rezaul Haque and Justice ABM Altaf Hossain passed the order. The BNP leaders filed two petitions on apprehension that they might be rearrested soon after being released from jail.
Earlier, they have secured bail from the HC and lower courts concerned in all the cases filed against them.
Salauddin Ahmed has been granted bail in four cases while Alal in seven. There is no legal bar to release the BNP leaders as they have been granted bail in all the cases filed against them, lawyers concerned said.
Advocate Khandaker Mahbub Hossain appeared for Salauddin while Advocate Zainul Abedin appeared for Alal.
Earlier, Salauddin was rearrested on May 17 from jail gate and was shown arrested in two cases while Alal was rearrested on May 8 from jail gate and shown arrested in two separate cases.
Hence, the leaders are now apprehending that they can be rearrested soon after getting release as the government had rearrested them from jail gate despite their bail in the cases filed against them, lawyers concerned said.
