HC says in full text of order
The High Court in the full text of an order has cleared the way for banks and other stakeholders to deal with beleaguered e-commerce platform Evaly on their own accord.
“Since this court has never passed any order to halt the activities of Evaly, it is for the banks and other stakeholders to deal with Evaly as per their choice. This court expected that if Evaly is allowed to carry on its normal business, eventually, it may be a profitable concern,” the HC bench of Justice Muhammad Khurshid Alam Sarkar said in the three-page full text of the order, which was released yesterday.
Earlier on December 6 this year, the HC passed the order on this issue after disposing of an application filed by Evaly, seeking necessary directives on the relevant state functionaries, including Bangladesh Bank and payment gateway service providers.
On that day, Evaly’s lawyer Ahsanul Karim prayed to the HC bench to pass an order so that the company can run its day-to-day affairs smoothly.
Lawyer Sayed Mahsib Hossain, who appeared for one Farhad Hossain, a depositor to Evaly, opposed the application.
However, the HC bench did not find any substance in opposing the application.
On September 19 this year, the HC-appointed board of directors of Evaly resigned some days after the bench ordered its existing board of directors to include the e-commerce platform’s former chairman, Shamima Nasrin, her mother and brother-in-law as its members.
The five-member board of directors was appointed by the HC in October 2021.
Bangladesh Bank has reportedly found that Evaly’s dues were Tk 404 crore as of the middle of March last year, including a liability of Tk 214 crore to its customers.
