A Dhaka Court on Wednesday rejected the bail prayer of Odhikar secretary Adilur Rahman Khan in connection with the alleged distortion of facts about the police raid on Hefazat’s May 5 rally in the capital. Dhaka Cyber Crime Court Judge AK Shamsul Alam passed the order after hearing the bail plea in presence of Adilur and his wife Saira Rahman Khan in the afternoon.
After hearing the plea, the court decided to pass order after half an hour.
The Judge then went to his chamber and issued the order after 45 minutes.
The court also set October 21 for the execution of warrant to absconding accused Odhikar director AKM Nasiruddin Elan.
Defense counsel Mohammad Asaduzzaman had filed the bail petition on September 19.
On that day the court did not hear the bail petition as the government did not appoint any public prosecutor to this court.
The defense counsel mentioned in his plea that the section under which Adilur was arrested is bailable and as the accused is a prominent lawyer and also a former deputy attorney general of the High Court Division, he is entitled to get bail.
The counsel argued that Adilur did not commit any crime of such section through the publishing the report. Police did not mention that Adilur published the report. So, he is innocent in the eye of law and he is entitled to get bail.
Additional public prosecutors of Anti corruption Commission Md Kabir Hossain and Amir Hossain opposed the bail plea mentioning that ‘the accused published fake and false report on a peaceful action of law enforcers on the Hefajat-e-Islam men in the capital on May 5 and early May 6. He also claimed that the accused posted fake and false photos on the death toll in the action to create anarchy.’
Gulshan police did not produce any report on the arrest of AKM Nasiruddin Elan.
Defense counsel Mohammad Asaduzzaman told New Age that they would move to High Court against this order. He also said that he will file a petition for certified copy of this order.
The Netherlands embassy representative Anne Van Dunen Littel, Sweden embassy representative Ludvig Bontell, and German embassy representative Kathrin Janesen, were present in the court during the hearing.
On August 10, DB inspector Md. Ashraful Alam filed general dairy with Gulshan police against Adilur and Elan.
On September 11, a Cyber Crime Court in Dhaka took cognizance of charges against them.
