Court accepts Limon’s mother’s objection
A Jhalakathi court on Thursday, after accepting ‘no-confidence’ (Naraji) petition of the complainant vis-à-vis the police report declaring RAB innocent of maiming Limon, asked the police to submit the case documents.
The same court, while correcting a previous order, asked for fresh investigation before the registering of the ‘murder case’ against Limon’s family.
Henoara Begum, mother of maimed college student Limon Hossain and complainant of the case, after appearing before the judicial magistrate’s court in Jhalakathi on Thursday noon filed her no-confidence petition against the police report on August 14.
Advocate Manik Acharya, along with legal experts of the Ain O Shalish Kendra, moved the objection petition against the final report of the police which declared the six accused members of RAB to be innocent of maiming her son by shooting him in the thigh.
After the hearing Nusrat Jahan, magistrate of the court, accepted the no-confidence petition and asked the police to submit all the documents related to the investigation of the case and fixed the date of hearing of the police report on 17 October, 2012.
On other hand, the same court after reviewing the police’s appeal revised the previous order and asked them to investigate the case of unnatural death and alleged murder
case simultaneously and submit their report to the court as early as possible before registering the murder case against Limon’s parents, elder brother, maternal uncle and six others.
Limon and his family members came under attack in the afternoon on August 20 (Eid day) at the Saturia-Idurbari crossing near their village by Ibrahim Hawladar, locally known as a RAB informer and witness no. 17 in the GR-45 case lodged by the RAB.
Forkan Hawladar, brother-in-law of Ibrahim, while trying to join up with Ibrahim died on the way from heart attack.
After the attack Limon lodged General Diary no. 771 against Ibrahim for injuring Limon, his mother Henoara and brother Sumon on the same day.
Lily Begum, wife of Ibrahim, also lodged case no. 15 on the ‘unnatural’ death of her brother Forkan in the same night.
SI Badal Fakir, investigating GD no. 771 lodged by Henoara, submitted the prosecution report as non-GR case no. 44 against Ibrahim under Sections 323 and 506(2) on August 28.
Jhalakathi’s senior judicial magistrate summoned the accused Ibrahim to the court on September 26.
Ibrahim Howladar also lodged GD no. 785 against Limon and his family members on August 20 with Rajapur thana and lodged a murder case against ten persons, including four family members of Limon, for ‘killing his brother-in-law Forkan’ with the Jhalakathi senior judicial magistrate’s court on August 23.
Magistrate Nusrat Jahan ordered the officer-in-charge of Rajapur thana to register the murder case under Sections 302, 323 and 34 of the Penal Code and the court order reached the thana at night on August 26.
However Tofazzal Hossain, officer-in-charge of Rajapur thana, said that the police after, receiving the order, appeared before the court on August 29 and said that complainant Ibrahim had not mentioned the UD case no.15 lodged on August 20 by his wife and sister of the deceased Lily Begum, and had again lodged a murder case with the court on August 23.
The police, after sending Forkan’s corpse to Jhalakathi Sadar Hospital’s morgue, told reporters ‘Forkan’s body did not bear any marks of injury.’
The post-mortem report has not yet been submitted and the viscera have been sent to Dhaka for detailed examination, so Tofazzal asked the court for further directions.
Limon Hossain, then 16, who used to work at a brick kiln to pay for his education, was maimed the member of a RAB squad at Saturia village in Rajapur upazila on March 23 last year.
The police submitted a charge-sheet against Limon and seven other accused in two cases filed by RAB on the same day with the local police against Limon under the Arms Act and another for obstructing official duty, making attempts to injure and murder RAB personnel.
